Terms of Service
These terms are the agreement between you and AffSERP for using the service at affserp.com and app.affserp.com. We have written them to be read, not skimmed past. By creating an account you agree to them. If you don't agree, please don't use the service.
The short version
- AffSERP generates content for you. You review it, you publish it, and you are responsible for it.
- Credits are words. Used credits are not refundable, because generating content costs us money the moment it runs. Failed generations are never charged.
- Follow the rules of the affiliate programs and platforms you publish to. That is on you, not us.
- Don't use the service to deceive people, break the law, or attack our systems.
- We can change these terms; we will tell you when we do.
1. What AffSERP is
AffSERP is a software service that researches products, writes articles using AI, and can publish them to websites and platforms you connect. It is a tool. It does not write on its own initiative, it does not publish anything you haven't asked it to, and it does not guarantee that anything it produces will rank, earn, or be approved by any third party.
2. Your account
- You must be at least 18 and able to enter a binding contract. AffSERP is for people running businesses, not for children.
- You are responsible for your account and everything done with it. Keep your password private and tell us at once if you think your account has been compromised.
- Give us accurate information, and keep it current. One person, one account; we may close duplicate or disposable-email accounts created to farm free credits.
- You may delete your account at any time from Settings. Deletion is permanent.
3. Credits, plans and payment
Content is paid for in credits. One credit is one word of generated content.
- Free credits. New accounts receive free credits after verifying their email, so you can judge the output before paying. We may change the amount or the conditions for new signups; we won't take credits away that you have already been given.
- Metering. Before a run starts we reserve enough credits to cover it. When it completes, you are charged for the words actually generated, which is usually less than the reservation. If a generation fails, you are charged nothing.
- Shared Amazon access. If you generate Amazon content using our Amazon API access rather than your own keys, an additional per-article charge applies. It is shown before you run. Connecting your own keys removes it.
- AI images use a separate allowance shown in the app. Beyond it, they are purchased.
- Plans renew automatically each billing period until cancelled. Cancel any time; your plan runs to the end of the period you have paid for. Credits included in a plan are for that period and do not roll over unless we say otherwise.
- Top-ups are one-time purchases and do not expire while your account is open.
- Prices may change. Changes to a subscription price apply from your next renewal, and we will tell you beforehand.
- Refunds are covered by our Refund Policy, which is part of these terms. In short: credit purchases are final, used or unused; anything that is our fault is put right.
- Taxes. Prices exclude any taxes we are required to collect, which will be added at checkout where they apply.
4. The content AffSERP generates
This is the section that matters most, so we will be direct.
- It is AI-generated, and it can be wrong. Product details come from live data where we can get them, but the writing is produced by a language model. It may contain errors, outdated facts, or claims that need checking. Review everything before you publish it.
- You own it. To the extent we hold any rights in the content generated for you, we assign them to you. You may use it as you see fit. We make no promise that it is unique across the internet or that similar content has not been generated for someone else.
- You are the publisher. Once content leaves AffSERP, you are responsible for it: its accuracy, its legality, its compliance with the rules of wherever you post it, and any consequences of publishing it.
- We may reuse your inputs to improve the service in aggregate, for example to tune prompts. We do not use your generated content or inputs to train third-party AI models, and we do not publish or resell your content.
5. Affiliate programs and platform rules
AffSERP is built for affiliate publishing, which comes with rules we do not control.
- You are responsible for complying with the Amazon Associates Operating Agreement and any other affiliate program you use, including disclosure requirements, restrictions on where links may appear, and rules about displaying prices.
- You are responsible for complying with the terms of any platform you publish to, such as WordPress hosts, Blogger and Shopify, and with search-engine guidelines on the sites you operate.
- Features such as automatic disclosures and link formatting are provided to help, not as a guarantee of compliance. Check your own obligations.
- If you use our shared Amazon access, you agree not to do anything that would jeopardise it: no self-purchasing through links, no incentivised clicks, no use that violates Amazon's terms. We may withdraw shared access from any account that puts it at risk.
6. Connected sites and credentials
- When you connect a site or an API, you confirm that you are authorised to do so and that you have the right to publish there.
- We store connected credentials encrypted and use them only to do what you asked: fetch product data or publish content. You can disconnect at any time, which deletes the credential.
- We are not responsible for what your connected platforms do with the content once it is published, or for changes those platforms make to their APIs.
7. Acceptable use
You may not use AffSERP to:
- Generate content that is illegal, defamatory, infringing, or that promotes hate, harassment or violence.
- Deceive readers, for example by fabricating reviews, testimonials or product claims, or by impersonating a person or brand.
- Circumvent the rules of Amazon, other affiliate programs, or the platforms you publish to.
- Probe, scrape, overload or interfere with the service, or attempt to access other users' accounts or data.
- Resell access to the service, or share one account across a business without a plan that permits it.
- Create accounts automatically or in bulk, or use disposable emails to obtain free credits repeatedly.
We may suspend or terminate accounts that break these rules, without refund of used credits.
8. Our intellectual property
AffSERP, its software, design, name and logo belong to us. These terms give you a right to use the service, not to copy it, resell it, or build a competing product from it. Content generated for you is yours, as described in section 4. Third-party product data and images remain subject to their owners' terms.
9. Third-party services
AffSERP depends on services we do not control: AI providers, Amazon's API, image providers, hosting, and the platforms you publish to. We choose them carefully, but we cannot guarantee their availability, pricing or continued existence, and their outages or changes may affect the service. Their own terms apply to their part of the work.
10. Availability and changes to the service
We aim to keep AffSERP available and reliable, but we do not promise uninterrupted service. We may add, change or remove features. If we discontinue the service entirely, we will give reasonable notice and a way to retrieve your content.
11. Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. In particular, we do not warrant that generated content will be accurate, original, or free of errors, or that using the service will produce any ranking, traffic, approval or revenue.
12. Limitation of liability
To the fullest extent the law allows, AffSERP will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service or the content it generates. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limits; where that is the case, they apply to the extent permitted.
13. Indemnity
If a third party makes a claim against us because of content you published, a site you connected, or your breach of these terms or of a platform's or affiliate program's rules, you agree to cover the resulting costs and losses, including reasonable legal fees.
14. Termination
- You can stop using AffSERP and delete your account at any time.
- We can suspend or terminate your account if you breach these terms, if required by law, or if your use creates risk to the service or other users. Where reasonable, we will tell you why.
- On termination your right to use the service ends. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity) do.
15. Governing law and disputes
These terms are governed by the laws of the jurisdiction in which AffSERP is established, without regard to conflict-of-law rules. Before starting any formal dispute, please contact us; most issues can be resolved quickly by email. Nothing here limits any rights you have under consumer protection law that cannot be waived.
16. Changes to these terms
We may update these terms. For material changes we will notify you by email or in the app before they take effect, and the date at the top will change. If you keep using the service after that, the new terms apply. If you don't agree with a change, stop using the service and delete your account before it takes effect.
