Terms of Service
These Terms of Service ("Terms") govern your access to and use of AffSERP (the "Service"), operated by AffSERP ("we", "us"). By creating an account or using the Service, you agree to these Terms. If AffSERP operates under a different registered legal entity name, that entity is referred to here as "we".
1. The service
AffSERP is a software tool that generates written articles (including Amazon buyer guides, informational articles, and affiliate reviews) from inputs you provide, and can publish them to destinations you connect (such as WordPress). The Service uses third-party AI models and third-party product data sources.
2. Accounts
You must provide accurate information and are responsible for activity under your account and for keeping your credentials secure. You must be at least 18 and able to form a binding contract.
3. Credits and payment
The Service operates on credits and/or subscriptions. Credits are consumed when you generate content. Purchases are handled by our payment provider; by purchasing you authorize the applicable charges. Credit balances and their expiry are described in the app and may be updated over time.
4. AI-generated content — your responsibility
Content produced by the Service is generated automatically and may be inaccurate, incomplete, or unsuitable for your purpose. You are solely responsible for reviewing, editing, and verifying any content before publishing or relying on it. We make no warranty that generated content is accurate, original, non-infringing, or fit for any purpose. You are responsible for ensuring your published content complies with all applicable laws and platform rules.
5. Affiliate programs and disclosures
The Service can insert your affiliate identifiers (for example, an Amazon Associates tracking ID) into generated content. You are responsible for complying with the terms of any affiliate program you participate in — including Amazon's Associates Program Operating Agreement — and with all required advertising and endorsement disclosures (such as FTC rules). We are not a party to, and are not responsible for, your affiliate relationships.
6. Content you publish and connected sites
When you connect a destination (e.g. a WordPress site), you authorize us to publish content there on your behalf using the credentials you provide. You represent that you own or are authorized to publish to those destinations. You are responsible for all content published to them through the Service.
7. Acceptable use
You agree not to use the Service to produce or publish content that is unlawful, infringing, deceptive, spammy, or in violation of any third party's rights or any platform's policies, or to attempt to disrupt or reverse-engineer the Service.
8. Intellectual property
As between you and us, you own the content you generate, subject to these Terms and the terms of the underlying AI providers. We own the Service itself, including its software and branding.
9. Third-party services
The Service relies on third parties (AI model providers, Amazon's APIs, image providers, your hosting/CMS, and our payment provider). Their availability and terms are outside our control, and we are not liable for their acts or outages.
10. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the [12] months before the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms.
12. Changes
We may update these Terms; material changes will be communicated through the Service. Continued use after changes means you accept them.
